1.Scope
These Terms & Conditions apply to all contracts concluded between Olive Hometex GmbH ("Seller") and consumers ("Buyer") via our website or app.
2.Contract Conclusion
Product listings constitute a non-binding invitation to order. A binding contract is concluded when the Seller confirms the order by email or dispatches the goods.
3.Prices and Payment
All prices shown include statutory VAT and are stated in EUR (or CHF where applicable for Swiss customers). Accepted payment methods are displayed at checkout. Payment is due at the time of order unless otherwise stated.
4.Delivery
Delivery times and shipping costs are shown at checkout and in our Payment & Shipping policy. Risk passes to the Buyer upon delivery of the goods.
5.Right of Withdrawal
You have the right to withdraw from this contract within 14 days without giving any reason.
The withdrawal period will expire 14 days from the day on which you, or a third party other than the carrier and indicated by you, acquires physical possession of the goods.
To exercise the right of withdrawal, you must inform us (Olive Hometex GmbH, Mahatma Gandhi Straße 40, 70376 Stuttgart, customer-care@olivehometex.de) of your decision by an unequivocal statement (e.g. a letter sent by post or email). You may use the model withdrawal form below, but it is not obligatory.
If you withdraw, we will reimburse all payments received from you, including standard delivery costs, without undue delay and within 14 days of being informed of your decision, using the same payment method you used, unless otherwise agreed. We may withhold reimbursement until we have received the goods back.
You must return the goods without undue delay and within 14 days of communicating your withdrawal. You bear the direct cost of returning the goods. You are only liable for any diminished value resulting from handling beyond what is necessary to establish the nature and characteristics of the goods.
The right of withdrawal does not apply to goods made to consumer specifications or clearly personalized (e.g. embroidered or monogrammed items), and to sealed goods not suitable for return for health or hygiene reasons if unsealed after delivery.

6.Warranty (Gewährleistung)
The statutory warranty rights apply. Please notify us promptly of any defects so that we can provide an appropriate remedy.
7.Liability
We are liable without limitation for intent, gross negligence, injury to life, body or health, and under mandatory statutory law. In other cases, liability is limited to foreseeable contractual damage.
8.Dispute Resolution
The European Commission provides a platform for online dispute resolution. We are neither obliged nor generally willing to participate in dispute settlement proceedings before a consumer arbitration board.
9.Data Protection
Information about the processing of personal data is available in our Privacy Policy.
10.Governing Law
German law applies, subject to mandatory consumer protection provisions of the country in which you have your habitual residence.
11.Severability
If any provision of these Terms & Conditions is invalid, the validity of the remaining provisions remains unaffected.
